1. Purpose
1.1 These terms and conditions of sale aim to define the contractual relationship between ALPIWEB and the buyer and the conditions applicable to any purchase made through the ALPIWEB merchant site, whether the buyer is a professional or a private individual.
1.2 Purchasing a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale.
1.3 These terms of sale shall prevail over any other general or specific terms not expressly agreed to by ALPIWEB.
1.4 ALPIWEB reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.
2. Characteristics of the products offered
2.1 The products sold are those listed in the catalogue published on the website.
2.2 These products are sold while stocks last.
2.3 Each product is accompanied by a description prepared by ALPIWEB.
2.4 The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect likeness to the product sold, particularly with regard to colours.
3. Prices
3.1 The prices listed in the catalogue are net prices in euros (VAT not applicable, article 293B of the French General Tax Code) applicable on the day of the order for a private buyer whose address is located within the EU. For a professional buyer or whose address is located outside the EU, the prices are exclusive of VAT and are in euros.
3.2 ALPIWEB reserves the right to change its prices at any time.
3.3 The prices shown do not include order processing, transport and delivery charges.
4. Geographical area
Online sales of the products presented on the site are reserved for buyers whose country is in the drop-down list of buyer address countries.
5. Orders
5.1 The buyer, who wishes to purchase a product, must:
– fill out the identification form on which he will indicate all the requested contact details;
– confirm your order after checking it;
– make the payment under the conditions stipulated;
5.2 Validating the order by proceeding with payment implies acceptance of these terms of sale, acknowledgment of having full knowledge thereof and waiver of any right to invoke one's own terms of purchase or other conditions.
5.3 All data provided and the recorded confirmation shall constitute proof of the transaction. The confirmation shall be considered a signature and acceptance of the operations carried out.
5.4 ALPIWEB will communicate by email confirmation of the order registered.
6. Withdrawal
Non-professional individual buyers have a withdrawal period of thirty days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.
7. Payment terms
7.1 Payment is required upon ordering. It can be made by credit card, check or bank transfer.
7.2 Payments by bank card will be made through the secure “Paypal” system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can access it during transport over the network.
7.3 The paper invoice will only be sent upon request from the buyer.
8. Deliveries
8.1 Deliveries are made to the delivery address indicated by the buyer.
8.2 The buyer assumes all risks from the moment the products leave ALPIWEB's premises. In the event of damage during transport, a formal complaint must be lodged with the carrier within three days of delivery.
8.3 Delivery times are given as an indication only; if they exceed thirty days from the order, the sale may be cancelled and the buyer refunded.
9. Warranty
9.1 All products supplied by the seller benefit from the legal guarantee provided for in Articles 1641 et seq. of the Civil Code.
9.2 In the event of non-conformity of a product sold, it may be returned to ALPIWEB who will take it back, exchange it or refund it.
9.3 All claims, requests for exchange or refund must be made electronically to the following email address: hello@alpi-web.fr within thirty days of delivery.
10. Responsibility
ALPIWEB, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other unintentional problems.
11. Personal Data
11.1 In accordance with the law relating to information technology, files and freedoms of 6 January 1978, personal information relating to buyers may be subject to automated processing.
11.2 ALPIWEB reserves the right to collect information about buyers including through the use of cookies, and, if it so wishes, to transmit the collected information to business partners.
11.3 Buyers may object to the disclosure of their contact details by notifying ALPIWEB. Similarly, users have the right to access and rectify their personal data, in accordance with the law of 6 January 1978.
12. Archiving - Proof
12.1 ALPIWEB will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
12.2 ALPIWEB's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
13. Dispute Resolution
13.1 These online sales conditions are subject to French law.
13.2 In the event of a dispute, jurisdiction is granted to the competent courts of CHAMBERY, notwithstanding multiple defendants or third-party claims.
